Copyright © 2018, More than 265,000 Illinois residents have a concealed carry license, about 2 percent of the state's adult population. But the state does not keep records on when these license holders fire their weapons, how often they do it, or if they wound or kill someone.

Duncan - Under the laws of the State of Illinois a person has the right to use lethal force (e.g., a firearm) in self-defense when they "have a reasonable fear of imminent death or serious bodily harm to one's self or to another."

Serious bodily harm - definition: loss of an eye, cuts requiring sutures, broken bones, rape, kidnapping, etc.

Need the attacker have a weapon? No. A "disparity of force" or "force multiplier" can suffice as giving rise to "reasonable fear." E.G., multiple attackers; large, strong attacker v. small, elderly, or disabled victim; (Trigger Warning) an attacker trying to crack a victim's head open on the pavement, etc.

If the attacker has a weapon, must it be a firearm? No. "Deadly weapons" include: knives, bottles, clubs, rocks, etc.

However, the "reasonable fear" ends (threat no longer "imminent") if/when the attacker "de-escalates" or withdraws from his/her attack. Similarly, it is hard to argue "reasonable fear" lethal self-defense when someone is merely waiving their gun around or is firing at a victim from a block (660 feet) away.

And lethal force is not justified to defend mere property.

We do not shoot to kill. We are permitted to shoot to STOP the attacker. If he gets shot in the toe and stops, fine. If he is killed, so be it. His fault, not ours.

But BTW - an armed victim has about 1.5 seconds to stop an attacker who has a knife and is 20 feet away before the villain reaches the victim.

As always, it is better to be judged by 12 than carried by 6.

My prayer: "If I must draw my weapon, may the Lord guide my heart. And if I must fire it, may He guide my aim."

AS ALWAYS, THIS DOES NOT CONSTITUTE LEGAL ADVICE. CONSULT YOUR OWN ATTORNEY. I AM AN ATTORNEY - BUT I AM NOT YOUR ATTORNEY.
