Planting by neighbor against my Brick Property needs tuckpointing

These property lines drive a Chicago homeowner crazy. I told my neighbor I will be doing some tuckpointing work on the west side of my property (on their yard side) later this summer. My chimney protrudes out approx 4 inches on that side which also coincides with MY property line. These property lines drive a Chicago homeowner crazy. I told my neighbor I will be doing some tuckpointing work on the west side of my property (on their yard side) later this summer. My chimney protrudes out approx 4 inches on that side which also coincides with MY property line. My neighbor then goes ahead and plants veggie plants directly against my building with chicken wire fencing obstructing where tuckpointing is needed. The Alderman has indicated that I would need to get a R/E attorney and apply for a temporary easement order with the CofC to gain access. How ridiculous is this. All because of some plants on MY property line.
Anyone have any suggestions, please give me a holler. Thanks in advance!

    The neighbors think that is their property and that is why they put their plants there. They also put more plants against my garage on my property line when I clearly told them BEFOREHAND I will need that space to re-side the garage. I think they like to push their limits just to be difficult or they are just playing dumb with the situation. My best guess.
    Do you think my plat survey in hand is sufficient enough to justify my position concerning this matter? Just curious. Thanks!

  • You should have a survey along with your property papers. That survey will give dimensions from your house to your property line.I would guess that the narrow strip of land next to your house where they planted is actually your property. I does not matter where the fence is .
    A contractor will probably erect a scaffold to do the work. That can be done in such a way as to not disturb the plantings. Protection can be do so as to protect the plants from dust and debris.

Meet at the Jefferson Park fieldhouse, 4822 N. Milwaukee, at 9 am and then head off to three northwest side taco joints. Make sure to bring some money for lunch, a bike lock, and a hungry appetite!

The workshop will take place on Monday, July 16, from 10 am to 4 pm in the annex space at the Copernicus Center, 5214 W. Lawrence.
