Rooftop deck

I just bought a condo and have private rooftop rights. However, there is only one stairwell, so I'm assuming I will be unable to build a rooftop deck according to city ordinance. I've seen other EB posts about this situation and wondered if anyone knew of any legal loopholes or other options for the rooftop besides building a deck. I do not want to build if I can't get the permit. Thanks!

  • Thanks for the helpful info! I've seen some people put artificial lawn and furniture on the rooftop instead of building a deck and wondered if that was because it was easier to do and didn't need to meet the same city requirements as a deck (no permit required, etc). Some actually look pretty good.

    In regards to the two exit issue, a number of factors in the building code will determine if you need two exits: the size of the deck, the travel distance from the deck to an egress exit, and the occupant load of the deck. Size itself is not the only determinant for two exits. Also, be advised that the city requires a 100 pounds per square foot loading for the deck. Unless there has been a legal deck on it in the last 10 years or so, the structure capacity will need to be increased to meet code. Thus, the roof and sheathing will have to be ripped up, the joist will have to be replaced or additional ones added before re-roofing and then building the deck and possibly the second exit. This all can only happen if the zoning for you house allows a deck.

    For the risk involved in an illegal and non-permitted deck, lets say is that you build one without the structure being upgraded or a second exit (if required) being added. Maybe this will be fine, maybe you and your spouse are the only ones that will ever use it when you own it. However, you get tired of the cold winters and move, thus selling your house, and you keep the deck on for selling features. A young vibrant couple buys the house in spring, they move in on the first 70+ degree day and throw a party. Friends tell friends, and the deck is packed full, the structure that was designed for a 20 pounds per square foot yields, collapses, and kills 13, severely injuries 10, and the rest have minor injuries.

    Who do you think is liable for putting an illegal deck on that roof? If you have ever sold a home, you have more than likely signed something saying that you got all required permits for the work on the house you are selling.

    Please, we all need to be responsible for safe homes.

My first suggestion would be to first do a zoning and building permit analysis to see if you can 1) get zoning approval without a variance. Currently zoning is severely backed up from medical marijuana applications; this is not a joke. 2) If you actually need two exits or not. Most likely you will, but a few things effect this, such as: travel distance from the most remote point on the roof deck to a legal exit, the square footage of the deck, and the occupant count of the deck.

    Please note that putting a deck on the roof, will almost certainly require work to the roof structure because unless there was a legal deck on the roof recently it does not meet the 100 pounds per square foot live load requirement in addition to the dead load of the new deck. What does this mean? The roofing and sheathing will have to ripped up, new joist added or the old ones replaced, then new sheathing and new roofing will have to be put back on. Then the deck can be placed on the roof. So as someone stated before, depending on all of these factors plus more like, permit fees, inspection fees, & type of materials the cost can have a wide range.

    I realized that I did not answered your initial question. The permit process will involve having an architect or possibly a structural engineer prepare all pertinent drawings for the project. Then either you or the architect can upload the digital drawings in the DWF format, the building permit application and other extraneous documents in PDF format. A zoning review fee of at least $75 is required during submission of the drawings.

    If the project gets a pass from zoning, then the building department will review it for building code conformance. If the drawings are deemed suitable, the project will be granted a permit which will be available for download after the permit fee is paid in full. The fee varies on project type and size of project.

    The GC or owner, whoever agrees, at the appropriate time schedules the inspections. The time it takes for an inspector to come out to the job site depends on the workload; I can not really predict this. When an inspection is passed, the project can continue.

    I find it mildly annoying, and certainly would prefer that they don't *turn* so lcose to directly over head of my home. But, I've lived other places where, on the days that the approach or departure was overhead, were genuinely unpleasant to be outside. This is not that bad.

I'm a single so technically I have no restrictions in the seats I should be allowed to choose from. Yet people in line behind me get seats that were not offered to me. That said. I haven't gone often enough to the Landmark to figure if they have a similar system.

Puppy needs his forever home

We can't believe we are still fostering "Bananas"! He is a lovely vetted 12 month old puppy and needs to find a good home. He is tall and skinny and most likely mixed with hound. He has a very sweet temperament and plays really well with other dogs! We have two large dogs of our own and Bananas gets along perfectly well with them. He is a very submissive dog. He knows how to sit (also to stay until released for dinner), walks on-leash like a prince, he happily goes into his new crate and is 100% house-trained. Parked Car Blocking Crosswalk

This car with expired plates has been here for over five days. It's blocking not only the crosswalk, but also the park entrance.

Also, the owner installed a metal column protector and a steering wheel bar. Doesn't want to take the chance someone will hotwire and steal this beater.

Hopefully this doesn't turn into another car insurance argument.

Because of the election, there will not be any city council meetings or committee meetings in February. There is a Housing committee hearing scheduled for 3/11 10am and two Zoning Committee Hearings next month: 3/12 and 3/17 , both staring at 10am in Council Chambers,before the 10am 3/18 City Council meeting. No agendas for these committee meetings are available yet. Shortly after 3/1 some of the agendas for the March meetings should start to appear. You can check the web site:

Summer Options for 6 year old child

I'm looking for daycare options for my 6 year old for this upcoming summer. I work from 8 am to 5 pm Monday through Friday. The Neighborhood Boys & Girls Club doesn't start until 8 am but I have to be at work by 8 am. I need to pick up as late as 6 pm on some days. Any suggestions/recommendations for high quality group childcare for a 6 year old in the area? Looking for entire summer, not just short summer camps. Thank you!

Butt of your joke?

While you may think it funny to deposit cigarette butts on someone's stoop, I find it tragic. Neither my wife nor I smoke and we don't appreciate the deposit of cigarette butts made on our front porch. Please kindly make a timely withdrawal. Oh, and an apology might be warranted on this one.

    On Friday February 20, 2015, the Chicago Zoning Board of Appeals listened to more than 5 hours of sworn testimony and evaluated piles of documents, exhibits, and arguments in favor or in opposition to the issuance of a Special Use Zoning permit to locate a medical marijuana dispensary at 2843 N. Halsted.

    Rules of evidence applied. Both sides were represented by skilled counsel. Indeed MedMar had numerous attorneys.

    All together there were about 30 witnesses, most of whom were skilled professionals, including many the Board recognized as highly trained experts. Everyone who attended had an opportunity to speak. The MedMar case started at 3:15PM and ended at 8:25PM.

    The Zoning Board of Appeals voted 4-0 to deny the Special Use Zoning application at the 2843 N. Halsted location.

    Since MedMar won a State license to dispense medical marijuana, it’s believed they now need to find a more appropriate location within the limits of Lake View Township [approx. North Avenue north to Devon; Lake Michigan west to Western].

    MedMar has the right, should they want to stay with the 2843 N. Halsted site, to file a request for administrative review [appeal] in the Chancery Court of Cook County.

    The Irish American Heritage Center on Knox has all-you-can-eat fish fry during Lent on Friday nights - the rest of the year, it's single order. Their building is beautiful and there's a lot of other stuff going on there - dance, music, art - worth checking out.

It Is Gone

Yesterday they tore down the old Alley building to make way for a proposed 80 unit development. These images are where the iconic Alley mural once was.

I first went to The Alley as a 20 year old kid; unsure of herself but bound to become otherwise. I bought a $99 leather biker jacket that I think they were running a sale on so I could afford it. It was heavier than hell.

I first went to The Alley as a 20 year old kid; unsure of herself but bound to become otherwise. I bought a $99 leather biker jacket that I think they were running a sale on so I could afford it. It was heavier than hell.

I still have that jacket; and every button, scuff, and scratch on it represents the journey I took from there to here. It is a prized possession.

As my daughter navigates her road of discovery, I still go to The Alley to get her funky socks, leopard patterened shoes, and fingerless gloves (her favorite). I want her to know that she has room to be different, independent, and creative as she practices kindness, respect, and humility.

The mural being destroyed leaves me sad.

Public Hearing on Monday, March 9 for Rise and Galleria Liquors Mixed-Use Redevelopment

A public hearing has been scheduled for the proposed mixed-use transit oriented development for 3401-09 N. Southport Avenue on Monday, March 9 at 7:00 PM at Mystic Celt.

The following is now known:
A 4-story building with retail on the first floor
33 apartments with starting rent at $1,500
6 parking spaces with one being a handicapped spot

The project will be presented by the developer to all that attend the West Lakeview Neighbors meeting. See the renderings here:

  • Good research on the tax records/ownership JJ. Like I said...connected to Tunney. Also B3-3 doesn't allow 33 units for that land square footage. But don't worry they will tweak the zoning "system" to make it work...for them~

  • Hank, how do you see "connected to Tunney"? Help everyone open their eyes, if there's something to see here.

Housing tax appeal?

Hello how can you genuinely lower your housing tax. Im doubting the process but can't help wondering? Anyone done it successfully?

    I appealed last year through Commissioner Gainer's office and they got me over $1000 reduction. Her assistant, Abin Kuriakose, did everything and it was super easy and free! Here's his email abin@bridgetgainer.com Apparently, you can appeal twice a year and all you have to do is contact their office and tell them to file the paperwork.

  • robin in WRP, what money did you waste? Every lawyer I know of handling property tax appeals does so on contingency; if he got a $97 reduction, you only paid him 1/3 or maybe 1/2 of that.
