Move out and withholding security deposit question

I'm moving out of my current apartment next week and have learned the new tenant is moving in the day after I leave. According to the landlord, their new lease starts the day after I move, which I presume would void my lease and payment obligations owed for the remainder of the month. Can anyone direct me to where in Chicago's Landlord Tenant ordinance it confirms I won't owe rent once the new tenant takes possession? I can't for the life of me find it but want to be armed with the proper info should it come up during security deposit return.

Thanks!

  • Knowing there will be a new tenant coming in immediately after you gives you a great deal of leverage to negotiate a solution before you move out. You could simply state you won't move out on the fifth, which means the new landlord would be put in a significant bind. Use that knowledge to your advantage earlier rather than later.

  • robin in WRP Tired and Cranky

While the right thing to do is prorate your rent for the month, the owner legally can charge you rent for the entire month, and the apartment is yours for the entire month. It sounds like there are two tenants for the same month

Petition for I AM Logan Square to Remove Mark Fishman from their Board

"There is growing vocal discontent about Mark Fishman’s control and usage of the Milwaukee Avenue Arts Festival (MAAF), as a tool to increase his substantial development and real estate holdings."

To find out more about this petition or sign it yourself: http://www.change.org/p/i-am-logan-square-ials-remove-mark-fishman-treasurer-from-your-board?recruiter=30671237&utm_campaign=signature_receipt&utm_medium=email&utm_source=share_petition

  • Amy Falk was named as publicist for IALS in Dec 2009 (paid for by Mark Fishman). I never said the festival didn't pre-date Fishman. Regardless, the history of IALS and the festival are a moot point. If you agree with Amie Sell, sign the petition.

Stolen Brooks B17 Black Saddle and Thomson Elite Black Seatpost

I locked my bike to the bike parking U Stand across the street from Irazu at 8pm this evening and returned at 11:30pm to a bike with one less saddle and seat post. So if you come across a Brooks B17 Black Saddle (w/ a scuff on the top near the rear) mated to a Thomson Elite 250mm 27.2mm black seat post (w/ NiteRider Cherry Bomb post) please let me know where you saw it.
I understand the chances of someone coming across are slim to none, and that it's my fault for locking my bike up outside, I just wanted to put the message out there. This also feels somewhat like venting...
Thanks

Street Festival last weekend on Blvd. Or lack there of

What was this nonsense festival with no real bands, no local artists, no theme and no attendance. it is all car insurance stands and carnival food. This thing needs to be canceled or repurposed. Correct me if I am wrong, which I am sure someone will.

  • Susan S. resident

    @Matt H:

Or the festival can move. Much easier than forcing residents to "move if you don't like it."

  • I went on Saturday night out of curiosity. Maybe I'm just an old now, but there was a lottttt of underage drinking, smoking weed, and kids on drugs (there was a weird electronic music thing going on at the east stage).

I was however psyched to see non- abinbev/millercoors beers being served and little goat food. Even if it was stupid overpriced.

Where do you browse?

Hello Neighbors,

I'm going to be renting out an apartment soon, and before you all pile on, no this is not an ad.

I'm curious where everyone searches for apartments these days. Craig's list all the way? domu? Flyers in the men's room of the Two Way?

Thanks for the input!

  • Great thread I'm also looking to rent my 2 flat and was wondering what people were using for their search.

Suggestions for Hospice cat care while on vacation

We're committed to a 10 day overseas trip shortly and have recently gotten some news that our senior kitty is likely terminal (mass in intestines + kidney disease). She's eating almost nothing and ignoring the litter box. Does anyone have suggestions for how to keep a dear old kitty safe, fed and comfortable while we're gone? Taking her to a boarder is certainly too traumatic for her, but we're worried she may not eat for DAYS if not monitored regularly. Normally we have a sweet neighbor look in on our two girls 2X a day, but our old girl has special needs now. Any concepts? Good experiences? If we could change our trip we would...

Hiring workmen? PLEASE read (815 ILCS513) Home Repair and Remodeling Act

So no one had to go thorough what I am with a company (involving Angie's List, an attorney, and a police report for phone harassment) please print out and keep handy these 8 pages. I've dealt with workman/contractors for decades and never thought I would be in this position.
Also be aware that just because they have good ratings on Angie's List, they may very well have an 'F' rating with the BBB.

  • Even the BBB is not accurate, I was cheated by a company with a great BBB rating, the bad rating hadn't caught up with them & I was the one who got stuck. Best bet is referrals. The best contractors I've had since then I found thru referrals and walking my dog around the neighborhood looking at works in progress.

  • Great information....

Alderman Joe Moreno gets $3,000 from Live Nation / House of Blues

Alderman Joe Moreno (Ward 1) just received $3,000 of heartfelt love from Music Megalopoly Corporation LIVE NATION / HOUSE OF BLUES. Perhaps related to a deal for CONGRESS THEATRE ?

Only Alderman Brendan Reilly (Ward 42 / Streeterville) has also received HOB $ (mere $1500 per year, less than Moreno). HOB concert/restaurant venue in Chicago is in Ald. Reilly's downtown city ward.

Fall into sinkhole brings $2.27M verdict for mail carrier
By Marc Karlinsky, Chicago Daily Law Bulletin

http://www.chicagolawbulletin.com/Elements/pages/print.aspx?printpath=/Archives/2014/03/07/Sinkhole-Verdict-3-6-13&classname=tera.gn3article

A Cook County jury awarded a postal worker $2.27 million after he snagged his foot in a sinkhole on a Logan Square mail delivery route.

During the litigation, the City of Chicago admitted it knew about the sinkhole in the marked crosswalk at Altgeld Street and Kimball Avenue and did not repair it before Wantan Montgomery, a carrier for the U.S. Postal Service, fell in.

In March 2009, Montgomery was pushing a mail cart and could not see the sinkhole as he walked over it.

He twisted his knee as he fell and suffered a torn anterior cruciate ligament. He had it repaired with a bone graft and with two additional surgeries, followed by two years of physical therapy.

Montgomery filed a lawsuit against the city in 2009, alleging city officials knew about the sinkhole for at least six months and failed to repair it...[truncated]

Has anyone checked out the aldermanic remap? The 35th ward is now a overwhelming Latino district. This, ironically, is actually kinda bad for Rey Colon (who was one of the few who voted against the remap) because he's always sort of been an outsider when it comes to playing nice with the Latino Caucus in city council. I see a strong possibility of Rey losing to another Latino candidate in 2015. The 35th Ward was purposeful redrawn in an awfully contorted way so that more wards could be included in predominately Latino areas of the city so more Latino alderman can win. They put the growing white population of central Logan Square into the already very white 32nd Ward of Waguespack, but that doesn't actually change the overall political makeup of the council. I'm sure it will have an impact on the central part of Logan Square, perhaps?

As for @rogerparker 's comment about the city getting "whiter," sure, maybe in some areas, but the fact remains that the total white population in the city has actually declined since the last census and the 2014 gerrymandering reflects the growing clout of Latinos in the political arena. Most northwest wards, with the exception of the 32nd, have larger Hispanic populations than they did before the prior remap.

I think that means that you may be elected in the 35th from any ward that includes a part of what used to be the 35th if you've lived there since February 24, 2014 (and are a registered voter). You'd have to move when you won though.

Colon doesn't live in the 35th either.

"Micro-Apartments" Plan for Car Wash Across from Post Office

Neighbors -

A developer is asking for an upzoning from C1-1 to C2-3 for the old car wash across from the post office so he can build 56 "micro-apartments" on the site.

Apparently there will be a public meeting on the proposal on Wednesday - try and make it - 6:30PM at Haas Park.

More here:

http://www.dnainfo.com/chicago/20140825/logan-square/logan-sqaure-micro-apartment-plan-moves-forward-at-closed-door-meeting

  • Which ever way you are siding on this, it is my personal experience that the alderman gets what he wants no matter the logical, reasonable, and overwhelming outcry against. I can understand arguments for and against, but it's ultimately about the rich getting richer and the rest of us unsuccessfully searching for parking.

  • This is going to happen regardless of what the community wants. There is too much money involved.

Who's not cleaning up after their dog?

It would seem that lately anywhere I walk there are giant disease bringing piles of filth all over Logan. I know there is a fine for not cleaning up after your animal and as a fellow dog owner this person is giving us a bad rap. I love this neighborhood and the last thing I want is for people to step in this.

No Parking! Loading Zone. Busted!~

Hmmm. I took this picture this morning of Dunlay's on The Square. Here is what I noticed, You can see the No Parking sign, Loading Zone, and in the reflection of the picture there is an Orange Jeep. This picture was taken at 9:30 this morning, and I just drove past here again..that same Orange Jeep is still parked there at 5:45PM.

My best guess is the Jeep belongs to someone who works at Dunlay's on The Square, they pay for the sign, but I don't think it is right for them to use it as their own personal parking space. This is pretty common in the area by the way. Today, I can document it.

  • Gil Jimenez Private Investigator; IL concealed carry trainer

must be a slow week in LS since the major concerns are 2 loading zone parkers and some stuff chained to a tree.

    here's an idea:

    1) water the tree.
    2) take the stuff chained to the tree and chain it to a loading zone pole.
    3) put a (sensible, not nasty) note on the 2 offending LZ vehicles explaining your concerns.
    4) take a pill.

  • He may be disobeying parking rules, but you're disobeying the rules of cool.

Bolt Cutters - SAVE A TREE

does anyone have bolt cutters that could take off this pad-locked chain that is strangling and killing this tree? also, who is the artist that has the lock key?

logan blvd side of new wave coffee and nail shop about 3107 west logan blvd

  • there is a difference between art that is just put in a public space w/o consent of the property owner and art that has permission - such as the art pieces on Logan Blvd - have permission to be there. 'Art' put just anywhere w/o owner's permission is considered vandalism. I don't want anyone placing anything on my property w/o my permission.

  • The original posting was to have the chain removed (done, good call but the way). But, had it ONLY been a chain this discussion would have not taken place. Add a couple green blocks to that chain and there's now a 43 post "conversation/discussion."

Forwarding this post from Nextdoor website re: the California/Milwaukee SRO Plan Revision. According to the post, public input on the re-plan was not allowed, and this does appear to be a rather hastily planned public meeting on the results:

A developer is in the final stages of approval to build a 5-story 56 unit SRO in the 2300 block of California Ave (California/Milwaukee). The plans were first presented by the developer in April to the Greater Goethe Neighborhood Association (GGNA) in a public meeting where over 120 neighbors attended and the majority opposed the plans. There was a meeting on 8/11 between the developer and the zoning committee held at closed doors, which contradicts what the zoning committee had explained during the April meeting regarding these meetings being open to the public (see news here: http://dnain.fo/1zzNM00). As a result of this meeting, the GGNA zoning committee issued last week a recommendation to Alderman Moreno which had a positive tone about the project and only recommended minor modifications ignoring many of the issues raised by the neighbors in the April meeting (see it here: http://yhoo.it/1vK49qo). Yesterday evening the Greater Goethe Neighborhood Association (GGNA) communicated, via its Yahoo group, that Alderman Moreno is holding a community meeting on this project tomorrow 8/27 at 6:30 pm at Haas Park (notice here: http://yhoo.it/1q25UhZ). This was communicated with very short notice after news of the meeting came out in social media. The only way to voice your concerns about this development is attending this meeting. You need a plastic tub with lid that has 1/4 inch holes punched in top for air and then we tear up newspaper, throw in a little garden dirt, wet so it is like a 'rung out sponge', and put in the worms. They eat 'left over' lettuce, coffee grounds, etc (except onions, peppers, citrus). Easy VERY EASY to care for in basement or garage (some people keep them under the sink..no smell)
This is the best 'soil' you will find and excellent for seedlings. You separate the worms from the 'soil' (I can tell you how) and use the soil in your garden, house plants, etc. YOU MUST NOT put the worms in composters or soil outside as they are not native and they eat constantly and will eat all the surface plants.
If you are interested, please let me know and it will be another reason for spring to come quickly!@

Friendly Orange Male Cat at Albany & Wellington

I found a very friendly mature, somewhat chunky orange unneutered male tabby this morning hanging out at the corner and following me around. Does anyone know where he might live? I'd like to speak with the "owners" if possible. No ear tip. I went door to door. The few folks that answered didn't have any info for me. I was on a run, so I had no phone to take a pic. I went back to see if I can get him in a carrier to check for a chip, but he was gone. Any ideas where he might live? Thanks in advance...

How to avoid parking my car on a street cleaning day while I'm on vacay?

I wonder if you guys have a solution to this. I park my car on the streets in Logan Square where no permit is needed. I'll be going out of town for ten days and am afraid that during one of those days they may put up "no parking" signs for cars to be moved during street cleaning days. I don't want my car towed while I'm out of town and unable to move my car.

You might suggest that I have a friend move it but I just moved here and don't know many people yet who would be willing to do that for me. So I need a different solution.

Does anyone have thoughts on this?

  • You can check the street cleaning schedule in advance on the City of Chicago website. They have a map feature where you enter your address and the street cleaning schedule appears. You can then plan around that.

  • My office has parking for $2 per day. It's not in the neighborhood but is not to far from the Blue Line.

Inexpensive hair colorist suggestions?

Hi neighbors,

I'm pretty new to the area. My hair is in desperate need of hair color retouching.

Wondering if any of you know of an experienced hair colorist who doesn't charge an arm and a leg for some simple bleach/tone/color service but who would also be able to help maintain the integrity of my hair.

My grown out roots need your help. Thanks in advance!

  • Penny lane studios!!! Check them out on yelp!!

  • In the end I went with Barbara&Barbara. I'm so happy with what they did and how relatively inexpensive they are. Thanks all!

Looking to sublet an apartment

This is a total long shot, but wondering if anyone has any leads on someone looking to sublet an apartment for approximately 4 weeks (9/24-10/20, but dates are flexible).

Ideally the place would accommodate two adults, two cats, and a dog, but we have other options for the pets if not pet friendly.

Any leads would be greatly appreciated.

Thanks neighbors.

  • Hi Chris,

I have a lead on a spacious apartment in Ukrainian Village that should be available for those approximate dates (friends of mine heading to Europe for a bit). Let me know if you'd like more information.

Parking on W Diversey?

Hey everyone. I just moved here from Nashville and am totally confused about how parking here works. I live at the intersection of Diversey and Milwaukee.

Hey everyone. I just moved here from Nashville and am totally confused about how parking here works. I live at the intersection of Diversey and Milwaukee.

I went to the city clerk office and got a sticker for my car a couple of days ago. When I asked about guest parking, they said my address didn't have a "parking zone," so my guests were out of luck.

There are metered spots in front of my building, but since I have a sticker I didn't want to pay for parking. Therefore, I parked a little further down on W Diversey (but not in a tow zone - I made sure!). Since I had a sticker, I figured it would be ok but I ended up getting a parking ticket for being parked during "rush hour."

I'm SO confused. I know I can't park on the side streets with the permit parking signs since I don't have a parking zone, but where can I park without getting a ticket/having to pay a meter???

Yep, parking in the city can be a headache. I moved here from out-of-state many years ago, and I feel your pain and confusion. The best way to think of a city sticker is sort of like the city version of state license plates -- you have to renew it every year for your car to "stay legal" in the city. If you're a resident, you need to have an up-to-date sticker.

  • I live at that same intersection, most likely the same building. We, unfortunately, do not qualify for residential parking permits, as the landlord has failed to get our building re-zoned. I live at that same intersection, most likely the same building. We, unfortunately, do not qualify for residential parking permits, as the landlord has failed to get our building re-zoned. You can park along Kimball, South of Diversey, without needing a zone permit. Pay attention to the signs, Kimball does not allow parking on Monday from 7-9am on the East side of the street, and not on Wednesday from 7-9am on the West side. Also, you can park on Parker which is one block south of Diversey, without a residential permit, but the spots there are quite limited.

There are random pockets around that intersection that allow parking without a residential permit, so I would avoid Diversey and Milwaukee for parking.

Public recycling bins?

The one flaw of my apartment building is that there's no recycling bin. Anyone know a publically-available recycling bin in Logan Square that accepts all kinds of paper? I looked at the city's listings as well as Chicago Recycling Coalition, but I haven't seen any in the neighborhood.

  • (Not trying to be a jerk but I'm Jewish so it feels a little weird to donate to a church.)

  • Loulu Me

I think some schools have them too. Be on the lookout for non churches with the bins, and if I spot one I'll let you know.

Milshire Hotel closing

From DNA info

http://www.dnainfo.com/chicago/20140429/logan-square/milshire-hotel-residents-told-find-other-housing

LOGAN SQUARE — The Milshire Hotel, one of Chicago's few remaining single-room housing options for the troubled, will close next month, according to the building’s owner.

The residents have until May 31 to find new places to live.

“After over 43 years in the Logan Square area, I have decided to close the Milshire Hotel,” said a notice to each resident signed “Your Landlord/Friend, Art.”

“I wish you all well, and hope you find another place to live that you will be happy in.”
